Terms of Service

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that you are not barred from using the Service under applicable law.

Accounts

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorized access. We may suspend or terminate accounts that violate these Terms, are used fraudulently, or create risk to us or other users.

Subscriptions, trials, and billing

Some features require a paid subscription. Prices, billing intervals, and any included free trial are shown at checkout. Payments are processed by Stripe, and by providing payment details you authorize us (through Stripe) to charge the applicable fees, taxes, and any renewal amounts.

Subscriptions renew automatically at the end of each billing period until canceled. You may cancel at any time as described in our Cancellation Policy; cancellation takes effect at the end of the then-current billing period. Free trials, if offered, convert to a paid subscription unless canceled before the trial ends.

All fees are stated in U.S. dollars unless noted and are exclusive of applicable taxes, which we may collect where required. Refunds, where available, are governed by our Refund Policy.

Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms. Daily generation limits, rate limits, and other usage controls may apply and may change.

Your content

You are responsible for the photos, prompts, and other materials you upload ("Your Content"). You represent and warrant that you own or have all necessary rights, consents, and permissions to submit Your Content and to allow us to process it to generate outputs, and that Your Content does not infringe or violate the rights of any third party or any law.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, reproduce, modify, and process Your Content solely to operate the Service, deliver your requested outputs, provide support, and maintain the security and integrity of the Service.

AI-generated outputs

Outputs are generated by AI based on your inputs and are provided as design inspiration only. They may be inaccurate, may not reflect what is physically, structurally, or financially possible in your space, and should not be relied upon for construction, structural, engineering, code compliance, valuation, appraisal, insurance, or real estate disclosure decisions. Always consult qualified professionals before acting on an output.

Subject to your compliance with these Terms, as between you and us, you may use the outputs you generate from your own inputs for your personal or internal business purposes, including for marketing your own property. Outputs may not be unique: similar inputs by you or others may produce similar outputs, and we make no guarantees of exclusivity.

Virtual staging outputs and other AI-modified images of real property must be clearly disclosed as AI-generated or virtually staged when used in real estate listings, advertising, or other public-facing materials, consistent with applicable MLS rules, advertising laws, and professional standards.

Acceptable use

You agree not to, and not to allow others to:

• Upload unlawful, infringing, defamatory, hateful, harassing, sexually explicit, or otherwise harmful content;
• Upload images of identifiable people without their consent, or images of minors in any unsafe context;
• Use the Service to create misleading representations of real property, commit fraud, or deceive consumers;
• Use the Service to generate content that violates third-party intellectual property, privacy, or publicity rights;
• Attempt to bypass safety filters, rate limits, authentication, or other security controls;
• Reverse engineer, decompile, scrape, or otherwise extract source code, models, or non-public data from the Service;
• Resell, sublicense, or provide the Service to third parties as a hosted service without our written permission;
• Interfere with or disrupt the Service or the networks or infrastructure that support it;
• Use automated means (bots, scripts) to access the Service except for officially documented APIs.

Third-party services

The Service relies on third-party providers, including payment processing (Stripe), hosting, email, and AI model providers. Your use of those services is governed by their own terms and policies. We are not responsible for their acts or omissions.

Intellectual property

The Service, including its software, design, branding, text, graphics, and compilations, is owned by Summit 23 LLC and protected by applicable intellectual property laws. Except for the limited rights expressly granted to you in these Terms, no rights are granted by implication, estoppel, or otherwise.

Feedback

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without obligation to you.

DMCA / copyright

If you believe content available through the Service infringes your copyright, send a notice to [email hidden] including: identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact information; a statement that you have a good-faith belief the use is not authorized; a statement under penalty of perjury that the information is accurate and that you are authorized to act on the rights owner's behalf; and your physical or electronic signature. We may remove allegedly infringing content and terminate repeat infringers.

Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT OUTPUTS WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUMMIT 23 LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS MAY NOT APPLY TO YOU.

Indemnification

You will defend, indemnify, and hold harmless Summit 23 LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

Suspension and termination

We may suspend or terminate access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms, risk to the Service or other users, non-payment, or as required by law. You may stop using the Service and cancel your subscription at any time. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution.

Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Except where prohibited by law, you and we agree that any dispute, claim, or controversy arising out of or related to the Service or these Terms will be resolved exclusively in the state or federal courts located in Clark County, Nevada, and you and we consent to personal jurisdiction and venue in those courts. Each party waives any right to a jury trial. Claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Export and sanctions

You may not use the Service in violation of U.S. export controls or sanctions, and you represent that you are not located in, or a resident or national of, an embargoed country or on any restricted-party list.

Changes to the Service or Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms; when we do, we will update the "Last updated" date above and, for material changes, provide additional notice where appropriate. Continued use of the Service after an update constitutes acceptance of the revised Terms.

Miscellaneous

These Terms, together with the Privacy Policy, Refund Policy, and Cancellation Policy, constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a corporate transaction. Notices to us should be sent to the email below.
